In a late-night incident on August 5, 2023, around 10:22 pm, the Cumby Police Department (PD) apprehended Eleazar Gasca near the 115 mm of I30. The arrest was made after an officer noticed Mr. Gasca urinating on the side of the interstate and detected the smell of alcohol on his breath.
As the Cumby PD officer approached Mr. Gasca, he observed him standing at the right rear of a vehicle engaging in public urination. The officer quickly recognized signs of intoxication when the suspect exhibited unsteadiness on his feet and appeared to be stumbling. Acting promptly, the officer made contact with Mr. Gasca and initiated further investigation.
Upon closer examination, it became evident that Eleazar Gasca was indeed under the influence of alcohol. Due to his impaired state and the potential hazard he posed to himself and others on the busy interstate, the decision was made to place him under arrest.
Mr. Gasca was charged with public intoxication, as it was clear that he was incapable of taking care of himself while under the influence of alcohol in a public space. The charge aims to maintain public safety and prevent any further risk posed by individuals engaging in such behavior.
Additionally, during the process of identification verification, it was discovered that Mr. Gasca did not possess a valid Identification Card. This omission added a secondary charge to his arrest, as it is a legal requirement for individuals to carry valid identification while in public.
