On Tuesday, August 2, 2023, the Cumby Police Department conducted a routine traffic stop on the interstate, which led to the arrest of Edward Henderson for possession of THC gummies exceeding the legal limit allowed in Texas.
Henderson was pulled over for speeding, driving at 84 mph in a 75 mph zone. During the roadside interview, officers noticed Henderson's nervous demeanor when asked routine questions. The situation took a turn when Henderson revealed that he owned a marijuana farm in Oklahoma.
Suspecting the presence of illegal substances in the vehicle, the officers asked for permission to conduct a search. Henderson voluntarily consented to the search, revealing a cooler in the passenger seat containing a package of Vapen Blood Orange THC Gummies, weighing approximately 45.67 grams. Additionally, an extra gummy was found in another bag located in the center console.
Under Texas law, the possession of THC gummies exceeding the legal limit is a serious offense. Due to the location of the traffic stop being within 1000 feet of the 111 mm, which houses a park with three or more working pieces of equipment, the charges were further enhanced for a Drug-Free Zone violation.
As a result, Edward Henderson was placed under arrest and transported to Hopkins County Jail without incident. He is now facing charges of "Possession of Controlled Substance PG 2" exceeding 4 grams but not exceeding 400 grams, with the added enhancement of being within a Drug-Free Zone. The charges against Henderson are classified as a Felony 1 offense.
