Hopkins County Man Arrested for DWI with Child Passenger

In the early hours of June 30, 2023, a traffic stop in Hopkins County led to the arrest of Nicolas Vasquez, 28, on charges including driving while intoxicated (DWI) with a child passenger.

A deputy from the Hopkins County Sheriff's Office initiated the traffic stop on the South Service Road at Texas St after observing Vasquez's vehicle failing to signal a turn and lacking a license plate light. Despite the deputy activating their emergency lights, Vasquez continued driving on the service road, passing multiple safe places to pull over. Eventually, he pulled into Canyon Creek Apartments.

During the traffic stop, the deputy noticed Vasquez making furtive movements inside the vehicle. Upon approaching Vasquez, the deputy detected a strong smell of alcoholic beverage emanating from the car. Vasquez appeared visibly sweaty and overly talkative. He complied with the deputy's request to exit the vehicle.

When asked about alcohol consumption, Vasquez admitted to drinking two alcoholic beverages approximately an hour before driving. He also confessed to concealing an open alcoholic beverage in the backseat. Adding to the gravity of the situation, Vasquez had his 11-year-old niece seated in the front passenger seat of the vehicle.

To determine Vasquez's level of impairment, he agreed to perform Standardized Field Sobriety Tests. During the tests, the deputy observed several clues of intoxication, including six clues during the Horizontal Gaze Nystagmus Test, one clue during the one leg stand, and three clues during the walk and turn test.

Despite the evidence of intoxication, Vasquez refused to provide a blood sample when presented with the DIC-24 Statutory Warning. Consequently, a blood search warrant was obtained and executed.

Following the incident, Nicolas Vasquez, a resident of Sulphur Springs, was taken into custody and booked into Hopkins County Jail. He faces several charges, including DWI with a Child Passenger under 15 years of age, for which his bond was set at $250,000. Additional charges include driving while license invalid, no license plate light, failure to maintain financial responsibility (warrant), and an expired driver's license (warrant).
