The Law Offices of Laird & McCloskey has achieved a significant victory in Collin County, securing a $6.2 million jury verdict on behalf of a Texas man who was left paralyzed after a spinal surgery.
Jurors in the 380th District Court sided with Lamar County resident Bill Proctor, 57, who suffered permanent neurological damage following elective lumbar spinal surgery in 2018. This verdict is believed to be the largest medical negligence award in Collin County's history.
Mr. Proctor underwent surgery based on a neurosurgeon's recommendation to address chronic lower back pain. However, evidence presented in the lawsuit revealed that during the procedure, Dr. Mark Viktor Silver inadvertently damaged nerves, leading to permanent impairment of bowel and bladder functions.
Moreover, the lawsuit alleged that the surgical team at Advanced Intra-Operative Monitoring Specialists failed to adequately perform neuromonitoring procedures, which could have detected and addressed nerve conduction changes in real time to prevent permanent injury.
Managing partners Seth McCloskey and Steven C. Laird represented Mr. Proctor in the lawsuit. Mr. McCloskey stated, "This was a clear case of medical negligence, and we are pleased that the jury agreed." He emphasized the life-altering consequences of the mistakes made by medical professionals entrusted with Mr. Proctor's health.
After a week-long trial, jurors found Dr. Silver 60% responsible for Mr. Proctor’s injuries, leading to him being held accountable for all damages under Texas law.
