Nathan Donald Pelham, 40, from Greenville, Texas, had agreed to surrender on charges of taking part in the January 6, 2021 U.S. Capitol riot in Washington D.C.

Pelham had been informed that the charges filed were four misdemeanors for participating in the riot.

On April 12, 2023, the Hunt County Sheriff's Office received a welfare check call request by Pelham's father worried about a child and a possible gun in the home, according a criminal complaint filed.

As officers approached his rural home in Hunt County, a child (Pelham's daughter) was sent out of the house and Pelham fired shots toward the officers.  The bullets hit objects nearby, but none of the officers.

According to court findings, one of the deputies said that a shot "came in so close proximity to myself that I could hear the distinct whistling sound as the bullet traveled by me and then strike a metal object to my right side”.

The child was placed into a patrol car for her safety.  The standoff lasted several hours.

According to an affidavit, the officers left the property at 12:21 am without making an arrest.

Sheriff Deputies returned later and searched Pelham's home were they found a 9mm pistol.

Pelham is facing up to 15 years in federal prison for the shooting.
