UPDATE:
The Jacksonville Police Department has issued a public warning that anyone who assists the suspect wanted in the recent officer shooting investigation will face arrest and prosecution.
Under Texas Penal Code §38.05 (Hindering Apprehension or Prosecution), it is a crime to intentionally harbor or conceal a person wanted by law enforcement, provide assistance to avoid arrest — such as transportation, money, shelter, false identification, or communication devices — or warn the person about police activity that could interfere with their capture.
Because the underlying offense in this case is a felony, those who hinder apprehension could face third-degree felony charges, punishable by two to ten years in prison and fines up to $10,000. Additionally, anyone who destroys, conceals, or fabricates evidence may be charged under Texas Penal Code §37.09 (Tampering with Physical Evidence), also a third-degree felony.
“If you give this fugitive a ride, a room, a phone, money, or a heads-up about police activity, you are committing a felony,” said Corporal Amanda Bragg, Community Engagement/PIO for the Jacksonville Police Department. “Do not throw away your freedom for someone who chose violence. The safest and only lawful choice is to call us immediately.”
The department emphasized that this warning applies to everyone, including family members, friends, acquaintances, and landlords. Anyone who has already had contact with the suspect should cease all assistance and contact investigators immediately. Voluntarily coming forward now may be considered in charging decisions, but continued assistance will be prosecuted to the fullest extent of the law.
