In the early hours of Friday, October 13, 2013, at 1:14 a.m., Delta County Constable Marshall Lynch attempted to stop a vehicle on a routine traffic stop near southeast 2nd Street in Cooper, Texas. The vehicle failed to stop, initiating a pursuit. Deputies from the Delta County Sheriff’s Office joined the pursuit, which concluded in the driveway of a residence in the 700 block of East Sherman Street.
Upon reaching the residence, Constable Lynch and sheriff's deputies confronted the driver, identified as 42-year-old Cooper resident Robert Nez. Nez refused to comply with their instructions and resisted arrest. Law enforcement officers managed to take him into custody, deploying OC spray during the arrest. Emergency medical personnel were called to the scene, and Nez was medically cleared of injuries.
Following the incident, Nez was transported to the Delta County Jail, where he was booked on charges of Felony 3 for Evading Arrest/Detention with a Vehicle and Misdemeanor A for Resisting Arrest Search or Transport. He is currently being held at the Delta County Jail on a $25,000 bond.
