TYLER, Texas — A 42-year-old Tyler man previously convicted of a child pornography offense has pleaded guilty in federal court to possessing illicit material while serving supervised release, announced U.S. Attorney Jay R. Combs.
John Matthew Emerson entered a guilty plea on Tuesday, July 21, 2026, before U.S. Magistrate Judge K. Nicole Mitchell in the Eastern District of Texas.
Violation of Supervised Release Terms
According to information presented in court, Emerson was actively serving a term of court-ordered supervised release following a prior federal conviction for possession of child pornography.
During a check on his compliance, federal authorities discovered Emerson in possession of a mobile phone that contained child pornography files, constituting a new federal offense and violating the explicit conditions of his post-conviction release.
Maximum Penalties and Sentencing Process
Emerson now faces up to 20 years in federal prison at sentencing for the new charge.
The statutory maximum penalty is prescribed by Congress, and Emerson's actual sentence will be determined by the court following the review of federal advisory sentencing guidelines and other statutory factors.
U.S. Magistrate Judge Mitchell ordered a presentence investigation to be conducted by the U.S. Probation Office. A formal sentencing hearing will be scheduled once the presentence report is completed.
