On January 8, 2025, a Brazos County jury sentenced Milton Miller to 45 years in prison after finding him guilty of Unlawful Possession of a Firearm by a Felon.
The case originated on December 31, 2021, when a Bryan resident reported an unauthorized man inside his home. The intruder, later identified as Miller, left the residence after being asked multiple times but was seen with a firearm. Bryan Police Department officers located Miller nearby, matching the caller’s description. He was found carrying a .22 caliber revolver and a black airsoft pistol in the waistband of his pants.
After confirming Miller’s prior felony conviction, officers arrested him for Unlawful Possession of a Firearm by a Felon.
Before jury selection began, Miller opted to represent himself. During the trial's guilt phase, jurors heard testimony from the resident who encountered Miller, the officers who arrested him, and Miller’s parole officer, who confirmed his status as a convicted felon. The jury deliberated for less than 30 minutes before reaching a guilty verdict.
At the punishment phase, the jury learned of Miller’s extensive criminal history, including four prior prison sentences. Notably, he had served 25 years of a 50-year sentence for Burglary of a Motor Vehicle in Dallas County. Due to his prior convictions, Miller’s punishment range was enhanced to 25-99 years.
Assistant District Attorneys Ryan Golden and Mark Stahman prosecuted the case, supported by Investigators James Woodward and Kindale Pittman.
“It is against the law for a person who has been convicted of a felony to possess a firearm in public, much less to possess a firearm in someone else’s home. This jury’s verdict sends a clear message that this conduct will not be tolerated in Brazos County,” Golden and Stahman stated.
