Former Kaufman County Deputy Arrested for Public Intoxication After Alleged Home Intrusion

A former deputy from the Kaufman County Precinct 2 Constable's Office, identified as 28-year-old Austin Barber, has been arrested and charged with public intoxication. The incident took place on Saturday, December 9, 2023, in the Emory, Texas, area.

The Rains County Sheriff's Office responded to a residence in the 1000 block of Rains County Road 1495 after receiving a report of an individual unlawfully entering a private residence. Upon arrival, the responding deputy found the homeowner restraining a partially clothed individual on the front porch.

The homeowner reported that he and his wife were watching TV when their child informed them of an unknown male inside their residence. The homeowner discovered the individual, later identified as Austin Barber, in the kitchen without pants, attempting to urinate on the kitchen wall. The homeowner promptly took action, dragging Barber outside and holding him down until law enforcement arrived.

Barber, who was employed by Kaufman County Precinct 2 Constable's Office at the time and is the son of Precinct 3 Commissioner Terry Barber, exhibited signs of intoxication during the incident. According to the report, he had a strong smell of alcohol, appeared confused, slurred his speech, and did not know his location or how he got there.

The responding deputy arrested Barber at approximately 11:30 p.m., and he was subsequently charged with public intoxication. The homeowners chose not to press charges for criminal trespass or other offenses. Barber was booked into the Rains County Jail following his arrest.
